Version 2026-10 · applies to ParkComfy 26.x
2.1 This Agreement is accepted by the Licensee when the Software is installed, run or configured on the Device, whether by the Licensee itself or by a Contractor acting on the Licensee’s instructions or behalf. By engaging a Contractor to install, configure or operate the Software, the Licensee accepts this Agreement.
2.2 A Contractor that installs, configures or operates the Software, or accepts this Agreement in the Software, declares that it does so on behalf of and with the authority of the Licensee, and undertakes to make this Agreement available to the Licensee. A Contractor that acts without such authority is bound by this Agreement itself. The Contractor may use the Software only to the extent needed to provide its services to the Licensee.
3.1 Subject to this Agreement, Licensor grants the Licensee a non-exclusive license to install and use the Software on the Device, for operating parking and vehicle access at the Licensee’s sites. Each License File covers one Device.
3.2 The Software is licensed, not sold. Licensor keeps all rights not expressly granted in this Agreement.
4.1 The license is issued to the Device, identified by its serial number. It cannot be moved to another device, and no License File is issued for another serial number in its place.
4.2 The license may be transferred only together with the Device. The new owner or operator of the Device becomes the Licensee under this Agreement; the previous Licensee may not keep or use any copy of the License File elsewhere.
4.3 Licensor does not revoke a license that has been issued, except under Section 13 (Termination).
5.1 A trial license is free of charge, enables all functions for 60 days from its issue date, and is intended for evaluation. One trial license may be issued for a Device.
5.2 When a trial license ends, the Software stops processing plate reads and operating gates until a valid license is installed. Licensor is not obliged to extend a trial license.
6.1 A license covers the versions of the Software stated in the License File (for example, up to a version year). Where no limit is stated, it covers all versions.
6.2 Licensor may, but is not obliged to, provide updates, fixes or support, unless agreed separately in writing.
The Licensee and the Contractor must not, and must not allow others to:
8.1 The Software runs on Axis devices and works with AXIS License Plate Verifier and other third-party products. These are not part of the Software; their availability, licensing and operation are governed by their own terms. The Licensee is responsible for obtaining and maintaining them, including the operating system version that the Software requires.
8.2 ParkComfy is not a product of Axis Communications AB, and Axis is not responsible for it. Axis, AXIS OS and AXIS License Plate Verifier are trademarks of Axis AB.
The Software makes access decisions based on plate recognition, which may be wrong or unavailable (for example because of misreads, weather, dirt, network or power failures). The Software is not a safety device. The safety of persons and vehicles at gates and barriers – such as vehicle detection loops, photocells, obstacle and impact protection – must be ensured by the gate and barrier systems themselves, installed and maintained under the applicable standards. The Licensee must not rely on the Software as the only means of control where a wrong decision could cause injury or damage.
10.1 Plate reads, vehicle images, logs and other data processed by the Software are stored on the Device or on equipment chosen by the Licensee. Licensor does not receive or have access to them.
10.2 The Licensee is the controller of these data and is responsible for processing them lawfully – including notices to data subjects, signage, retention periods, access control and data security – under the General Data Protection Regulation (GDPR) and other applicable law.
10.3 Data provided to Licensor when requesting a trial license or buying a license are processed as described in the privacy notice at www.parkcomfy.com.
To the maximum extent permitted by law, the Software and the License Files are provided “as is” and “as available”, without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted or error-free operation, and non-infringement. The Licensee is responsible for choosing the Software for its purposes, for its configuration and for checking the results.
12.1 To the maximum extent permitted by law, Licensor is not liable for any indirect, incidental, special or consequential damages, loss of profit, revenue, business, data or goodwill, or for damages arising from misreads, wrong access decisions, gates opened or not opened, downtime, or the acts of third parties or third-party products.
12.2 Licensor’s total liability arising from or related to this Agreement and the Software is limited to the amount paid to Licensor for the license of the Device concerned. For a trial license or any license provided free of charge, Licensor is not liable to the maximum extent permitted by law.
12.3 Nothing in this Agreement limits or excludes liability for damage caused intentionally or by gross negligence, for damage to life, physical integrity or health, or any other liability that cannot be limited or excluded under applicable law.
13.1 This Agreement applies for as long as the Software is used on the Device.
13.2 If the Licensee or its Contractor materially breaches Sections 4 or 7, Licensor may terminate the license by written notice. On termination the Licensee must stop using the Software and remove it from the Device. Fees paid are not refunded.
The Software contains open-source components, listed with their licenses in the third-party notices. These components are governed by their own licenses; nothing in this Agreement restricts the rights those licenses grant.
This Agreement is governed by the laws of Hungary, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. The courts of Budapest, Hungary, competent by subject matter, have exclusive jurisdiction, unless mandatory law provides otherwise.
16.1 This Agreement, together with any separate written agreement on fees or support, is the entire agreement about the Software. If a provision is invalid, the rest remains in effect and the invalid provision is replaced by a valid one closest to its purpose.
16.2 Licensor may publish new versions of this Agreement for new versions of the Software. The version accepted for a version of the Software applies to that version.
16.3 This Agreement is written in English. If it is translated, the English version prevails.
